Welcome to MovieTQ (also known as "Movie Trailer Quiz"). These Terms of Service ("Terms") govern your access to and use of the website located at movietq.com and any related applications, services, and features (collectively, the "Service").
Please read these Terms carefully before using the Service.
1. Acceptance of Terms
The Service is operated by Caellum LLC, a Maryland limited liability company ("Company," "we," "us," or "our"). When we say "you" or "your," we mean you as an individual user of our Service, along with any entity you may represent.
By accessing, registering for, or using the Service, you signify your agreement to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must stop using the Service immediately.
2. Eligibility and Minors
To use the Service, you must be at least thirteen (13) years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher).
If you are under eighteen (18) years of age (or the age of majority where you live), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are a parent or guardian agreeing to these Terms for a minor, you agree to be fully responsible for their activities on the Service.
You represent that you have the legal capacity and authority to enter into these Terms.
3. Description of Service and Availability
MovieTQ is a real-time multiplayer browser game where users compete to guess movies from short trailer clips.
We reserve the right to modify, suspend, restrict, or discontinue any part of the Service, temporarily or permanently, at any time without notice. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
4. Accounts, Security, and Deletion
To access certain features of the Service (such as achievements, score progression, friends, direct messages, inventory, and custom profiles), you may be required to register an account.
- Information Accuracy: You agree to provide accurate, current, and complete information and to keep it updated.
- Account Security: You are responsible for safeguarding your password and credentials. We strongly recommend using a unique password for MovieTQ that you do not reuse on other websites or services. You may not share your account or let anyone else access it. You must notify us immediately at
[email protected]if you suspect unauthorized access. - Third-Party Logins: If you register via a third-party service (such as Discord), you authorize us to access and use information permitted by that provider's access controls.
- Termination & Deletion: We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms. You may request account deletion at any time through the Profile settings, which initiates a 14-day grace period during which you can cancel the request. After 14 days, deletion of your data is permanent.
5. Acceptable Use and Rules of Conduct
You agree to use the Service solely for personal, non-commercial, and lawful purposes. You are strictly prohibited from engaging in any of the following:
- Cheating and Abuse: Using bots, scrapers, hacks, mods, automated scripts, or any third-party tools to gain an unfair advantage or exploit bugs.
- Harassment & Hate Speech: Posting, sending, or transmitting defamatory, abusive, bullying, harassing, hateful, violent, racist, or obscene chat messages or profile customizations.
- Security Violations: Attempting to bypass access controls, reverse engineer the source code, disrupt servers, upload malware, or execute prototype pollution attacks.
- Impersonation: Falsely claiming to be a moderator, admin, another player, or representative of Caellum LLC.
- Commercial Use: Selling accounts, virtual currency ("Popcorns"), or virtual cosmetic items outside authorized game systems.
We reserve the right (but have no obligation) to monitor gameplay, public chats, direct messages, reports, and profiles for moderation, safety, abuse prevention, support, legal compliance, and enforcement of these Terms. Direct messages are not end-to-end encrypted, and authorized administrators and moderators may access them through moderation logs or administrative tools for those purposes.
6. User-Generated Content (UGC)
You retain ownership of any intellectual property rights you hold in content you submit, post, or display on the Service (such as chat messages, display names, and profile text).
By submitting content to the Service, you grant Caellum LLC a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to host, store, reproduce, adapt, display, distribute, and moderate your content solely for the purpose of operating, improving, and promoting the Service.
You represent and warrant that you possess all rights and permissions necessary to grant this license.
7. Intellectual Property Ownership
- Company IP: Caellum LLC and its licensors own all right, title, and interest in and to the MovieTQ software, database systems, matchmaking architecture, original artwork, branding, logos, and proprietary designs. These are protected by US and international copyright, trademark, and intellectual property laws. Your use of the Service grants you only a limited, personal, revocable, non-exclusive, and non-transferable license to play the game in accordance with these Terms.
- Third-Party Content: MovieTQ does not own, host, store, upload, or claim any ownership of the movie trailers, film posters, metadata, or studio branding displayed during the game.
- Movie Information: The movie facts used in the game (such as titles, release years, and genres) are drawn from a static, internally-maintained reference dataset. The Service performs no real-time requests to any third-party movie-data provider during gameplay and is not continuously synchronized with any external service; the information may therefore be incomplete or out of date.
- YouTube Embeds & Video Streams: All trailer clips are embedded and streamed directly from YouTube using official public embeds from public channels. MovieTQ is not affiliated with, sponsored by, or endorsed by Google, YouTube, or any movie production studio. Your viewing of embeds is subject to YouTube's Terms of Service and privacy controls.
- Takedown at Source (YouTube): Because all video streams are public YouTube embeds, copyright owners hold complete control over the accessibility of their content. If you are a copyright owner and wish to prevent your trailers from being streamed or shared on our or other third-party services, you can disable public embedding in your YouTube settings or submit a takedown directly to YouTube. Taking a video down or disabling embeds on YouTube will automatically and immediately block playback on MovieTQ.
8. Copyright and DMCA Policy
If you believe that any content streamed or referenced on our Service infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) notification to our designated agent.
Because we do not host or store any video files on our servers, we recommend addressing copyright issues directly with the hosting provider (YouTube) where the video files are stored. However, if you wish to request that we remove a specific trailer link or identifier from our game's database rotation, you can send an electronic notification to our designated agent.

To be valid, your DMCA notice must be in writing and include the following:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information sufficient to permit us to locate the material (such as the specific YouTube video URL or ID).
- Your contact details (address, phone number, and email).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
9. Virtual Items, Currency, and Account Entitlements
The Service includes a virtual currency ("Popcorns"), virtual cosmetic items (such as avatars, titles, and backgrounds), and account progression and status (such as levels, XP, achievements, stats, ranks, and inventory) — collectively, "Entitlements".
- License Only: All Entitlements — including Popcorns, virtual items, levels, and progression, and regardless of whether they were given for free, earned in-game, awarded, or acquired through a purchase — are licensed to you under a limited, personal, revocable, non-transferable, and non-sublicensable license. You do not own any Entitlement; you hold only a revocable license to use it within the Service.
- No Cash Value: Entitlements have no real-world monetary value, cannot be redeemed for cash, and cannot be traded or sold outside the Service.
- Discretionary Grants and Revocation: We may grant, add, withhold, modify, reset, suspend, or revoke any Entitlement — in whole or in part, for any reason or no reason, at our sole discretion, and with or without prior notice. This includes (without limitation) adjusting Popcorn balances, resetting levels or progression, removing cosmetics, and revoking items that were obtained through a purchase, whether for game-balancing, operational, technical, legal, anti-abuse, or other reasons. Except where required by applicable law, we are not obligated to provide any refund or compensation for an Entitlement that is adjusted, reset, or revoked.
- Corrections: Without limiting the foregoing, we may also correct balances or revoke access where we detect errors, fraud, exploits, bugs, or violations of these Terms.
- Free Reward Features: The Service may offer free reward features — such as daily check-ins, the Daily Calendar, reward chests, and similar promotions — that grant Entitlements at no charge, sometimes based on disclosed chance odds. Participation never requires a purchase. Prizes from these features are Entitlements under this Section 9. Anything granted by mistake — including through a bug, glitch, exploit, mispricing, misconfiguration, or any behavior that is not an intended part of the feature — is not an intended reward, creates no entitlement, and may be removed or corrected without notice or compensation. We may modify, pause, reset, or end any free reward feature (including its rewards, schedule, and odds) at any time.
- Randomized Items: Some items available for Popcorns have a randomized outcome — for example, the Orb of Recoloring and the Orb of Transformation, which change a pet's appearance. Before you use one, we display the odds of each possible result. Every randomized item always delivers its stated function (for example, a recoloring always recolors, and a transformation never lowers a pet's grade); the random result affects appearance only. Like all Entitlements, these items and their results have no cash value and cannot be traded, sold, or cashed out. Randomized items can also be obtained for free through in-game features such as the daily pet chest. Where the law of your region restricts the sale of paid randomized items, we do not offer them for purchase in that region (for example, purchases of these items are currently disabled in Brazil).
- Public Display Purchases (Walk of Fame): Some Entitlements bought with Popcorns — currently Walk of Fame stars and "bumps" — place text you choose (such as a name or a short message) on public display in the Service. You must hold any rights needed for the text you submit. All such text is subject to our content standards and filtering, and content we consider improper — as loosely defined by MovieTQ, in our sole discretion — may be edited, replaced, hidden, or removed at any time, without notice and without refund of the Popcorns spent. A bump repositions your star at the moment it is used and is consumed instantly; wall positions change as other players buy and bump. "Permanent" display means for the life of the Service; display placement, styling, and page layout may change; and stars are removed if the owning account is deleted. Public-display purchases are Entitlements under this Section 9.
- Gifts: Where offered, certain purchases (such as Popcorn packs and one-month memberships) can be bought as a gift for another registered account, identified by its username. Gifted items are delivered to the recipient's account, become the recipient's Entitlements, and are subject to the same rules as direct purchases (including this Section 9 and the Refund & Cancellation Policy). We may decline, block, or reverse gifts involving ineligible accounts (for example guest accounts, the buyer's own account, or accounts scheduled for deletion), and gifting a membership to an account that already has one is not permitted.
- Purchases and Refunds: Any purchase of Entitlements is additionally governed by our Refund & Cancellation Policy, which forms part of these Terms.
10. Purchases, Memberships, and Billing
MovieTQ offers optional real-money purchases. All payments are processed by our third-party payment provider, Stripe — we never see, receive, or store your full card or bank account details. What we offer:
- Popcorn packs — one-time purchases of "Popcorns," our in-game virtual currency (see Section 9), delivered to your account immediately upon successful payment.
- Memberships — optional paid subscriptions (currently Plus, Pro, and Cinephile), offered on monthly and annual billing intervals, that grant benefits such as faster Popcorn and XP earning and cosmetic perks while active. Membership does not affect match scoring.
- Gifts — where offered, Popcorn packs and one-month memberships may be purchased as a gift for another registered account (see Section 9). A gifted membership is a fixed one-month term and does not auto-renew.
Pricing, currency, and taxes. The price of each item is shown before you confirm your purchase. Where supported, prices are displayed in your local currency (for example, US dollars or Brazilian reais); otherwise they are in US dollars. Any taxes we are required to collect are shown and added at checkout.
Automatic renewal of memberships. Paid memberships are auto-renewing subscriptions. Unless you cancel, your membership automatically renews at the end of each billing period (monthly or annual, as selected) and your payment method is charged the then-current price for the next period, and so on, until you cancel. You may cancel at any time — with no call or email required — in Settings → Membership → Manage subscription, which opens Stripe's self-service billing portal; cancellation is as easy as signing up. When you cancel, your membership stays active until the end of the period you have already paid for, and you are not charged again. If a renewal price will change, we will notify you in advance so you can cancel before it takes effect. Gifted one-month memberships do not auto-renew and involve no recurring charge.
Refunds and immediate delivery. Everything we sell is digital content delivered immediately, so purchases are governed by our Refund & Cancellation Policy, which forms part of these Terms and describes when refunds are and are not available — including any non-waivable statutory rights you may have. By completing a purchase, you request immediate delivery of the digital content.
Chargebacks and payment disputes. If you have a billing problem, please contact us first (Section 17) — most issues are resolved faster and more easily that way. Initiating a chargeback or payment dispute with your bank or card issuer, instead of contacting us, authorizes us to reverse the disputed purchase and the Entitlements it delivered (including adjusting your Popcorn balance and revoking items obtained with it, as described in Section 9), and may result in the suspension or permanent termination of your account and the revocation of your Entitlements, to the extent permitted by law. This does not limit any non-waivable statutory right you may have, including your right to dispute a genuinely unauthorized charge.
Availability and changes. We may add, change, remove, suspend, re-price, or discontinue any item, membership, tier, or benefit at any time. Some purchases may be unavailable in certain regions where local law restricts them (see Section 9 regarding randomized items). Purchases require an eligible registered account, and purchases by users under 18 require the consent of a parent or legal guardian (Section 2).
From time to time, the Service may also display promotional or informational listings for transactions that are not completed through the Service — for example, listings in the Store's "UNIQ" section (formerly "Misc"), including any listing offering the MovieTQ website and business for sale. Such listings are invitations to negotiate only, not binding offers: nothing is sold through the Service by displaying them, no rights arise from viewing them or contacting us about them, and any resulting transaction occurs off-platform under a separate written agreement, and only once that agreement is signed by both parties. All displayed pricing, items, listings, and offerings — including the terms, price, and availability of any such listing — may be changed, suspended, or withdrawn at any time, for any reason, without notice, unless and until such a separate written agreement is signed.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST PERMITTED BY LAW, CAELLUM LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, FREE OF VIRUSES OR ERRORS, OR THAT DATA TRANSMITTED THROUGH YOUTUBE OR OTHER THIRD-PARTY SERVICES WILL BE COMPLETELY SECURE OR ERROR-FREE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAELLUM LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO CAELLUM LLC FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless Caellum LLC, its members, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your access to and use of the Service;
- Your violation of any term of these Terms;
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
- Any claim that your User-Generated Content caused damage to a third party.
14. Governing Law and Disputes
These Terms and any dispute arising out of or related to them shall be governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the state or federal courts located in the State of Maryland, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
15. Changes to the Terms
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by posting a prominent notice within the Service or by displaying an in-product alert on login.
The updated Terms will display a new "Last Updated" date. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the revisions. If you do not agree to the updated Terms, you must stop using the Service.
16. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and any additional terms presented for specific features, constitute the entire agreement between you and Caellum LLC regarding the Service, and supersede any prior or contemporaneous agreements, communications, or understandings.
- Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. Any waiver must be in writing to be effective.
- Assignment: You may not assign or transfer these Terms or your account, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, to a successor or affiliate, including in connection with a merger, acquisition, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.
- No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
- Relationship of the Parties: No agency, partnership, joint venture, or employment relationship is created by these Terms.
- Electronic Communications: You consent to receive communications, agreements, notices, and disclosures from us electronically — by email or by posting within the Service — and you agree that such electronic communications satisfy any legal requirement that they be in writing.
- Feedback: If you send us suggestions, ideas, bug reports, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback for any purpose, without any obligation, attribution, or compensation to you. This is separate from, and does not affect, any voluntary reward we may choose to grant for an accepted bug report or feedback submission.
- Survival: Provisions that by their nature should survive termination — including the Virtual Items, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and General Provisions sections — will survive termination of these Terms or your account.
